1. Acceptance of Terms
By downloading, installing, or using The 42 ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Age Requirement
You must be at least 13 years old to use The 42. By using the App, you confirm that you meet this age requirement.
Users between 13 and 17 must have a parent or guardian review these Terms before use. By allowing a minor to use the App, the parent or guardian agrees to these Terms on the minor's behalf.
3. Account
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately if you suspect any unauthorised use of your account.
We reserve the right to terminate accounts that violate these Terms, engage in cheating or abuse, or have been inactive for more than 24 months.
4. In-App Purchases
The 42 offers optional in-app purchases, including Season Passes, case unlocks, and Bookstore items. All purchases are final and non-refundable except where required by applicable law or app store policy.
Virtual coins, items, and Season Passes purchased within the App have no monetary value outside the App and cannot be transferred, traded, or sold.
Purchases are processed by Apple App Store or Google Play, as applicable. Their respective terms govern those transactions.
5. Intellectual Property
All content in The 42 — including case content, characters, writing, artwork, design, code, and brand identity — is owned by or licensed to The 42 and protected by copyright, trademark, and other applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from any content in the App.
6. Educational Disclaimer
The cases and legal scenarios in The 42 are adapted from real-world events for educational and entertainment purposes. They do not constitute legal advice and should not be relied upon as an accurate statement of any jurisdiction's law.
The 42 draws on Commonwealth legal traditions (UK, Australia, Canada, India, New Zealand, Singapore, and related jurisdictions). Each jurisdiction's laws differ. Nothing in the App represents the law of any specific country.
7. User Conduct
You agree not to:
— Use the App for any unlawful purpose
— Attempt to reverse-engineer, decompile, or hack the App
— Use automated tools, bots, or scripts to manipulate gameplay
— Submit false or misleading information
— Harass or harm other users through PvP or community features
8. PvP Debates
The App contains PvP debate features where players wager XP stars. PvP wagering involves XP stars only — not coins, real money, or items. This design is intentional to avoid gambling classification under applicable law.
We do not guarantee fair or balanced PvP matchmaking and are not responsible for losses incurred through PvP play.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.
10. Limitation of Liability
To the fullest extent permitted by applicable law, The 42 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, loss of virtual items, or loss of goodwill.
Our total liability to you for any claim arising from these Terms or the App shall not exceed the greater of (a) AUD $10 or (b) the amount you paid to us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
12. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
